Earlier today, two media sources in Miami reported that unnamed sources with knowledge of the Stallworth investigation said his blood-alcohal level was over the legal limit at the the time of the fatal accident.
Stallworth's attorney Christopher Lyons tells Fox 8 News, "I have been in constant contact with Donte and we have not been made aware of any toxicology report."
Lyons went on to say, "The [Miami Dade Office of the] state's attorney office has not made us aware of the results of any toxicology report."
The Miami Beach Police Department refused to confirm the media reports.
Ed Griffith, spokesman for Miami-Dade County prosecutor Katherine Fernandez Rundle told Fox 8 News, Rundle's office has not filed any chages and the results of the toxicology report have not been finalized.
Griffith went on to say that if the results showed Stallworth was above the legal limit, he could be charged with DUI manslaughter, which carries a maximum 15-year prison sentence. Griffith described the prosecutors office's dealing with DUI manslaughter cases as "extremely serious."
According to Lyons, "[Stallworth] is currently in Cleveland," and "has been at the Browns facility working out for the past two days."
"[Miami Beach] police and the [Miami Dade Office of] state's attorney's office are well aware of Donte's where-abouts," said Lyons.
Fox 8 News sought comment from both Stallworth and his agent, Drew Rosenhaus, on the media reports. Neither returned voice mails left by Fox 8 News.
Stallworth signed a seven-year, $35 million contract with the Browns as a free agent before last season but was injured much of the year.
